After a crash you are dealing with an injury, a car you cannot drive, wages you are not earning and bills that arrive anyway. The insurance company is dealing with none of that. It has one job, and it is not looking after you.

Florida's no-fault system, and its limits

Florida requires drivers to carry Personal Injury Protection (PIP), which pays 80% of medical expenses and 60% of lost wages up to a $10,000 limit, regardless of who caused the crash. Two things about PIP catch people out:

  • The 14-day rule. You must seek initial medical treatment within 14 days of the crash, or PIP will not pay at all. Not "when the pain gets worse" — 14 days.
  • The $10,000 ceiling. And it is only $2,500 unless a qualified provider diagnoses an emergency medical condition. A single MRI and a course of physical therapy will exhaust it.

To recover beyond PIP — pain and suffering, the balance of your medical bills, future care, lost earning capacity — you must show a permanent injury under Florida's threshold. That is a medical question, and it is one reason the doctors you see early matter.

The deadline

For crashes occurring on or after March 24, 2023, Florida's statute of limitations for most negligence claims is two years from the date of the incident, cut down from four. Wrongful death claims are two years. Claims against a government entity carry their own, shorter, notice requirements. Missing the deadline ends the claim no matter how strong it was.

Common questions


What does it cost to hire you for an injury case?

Nothing up front. Personal injury work is handled on a contingency fee — we are paid a percentage of what we recover, and if there is no recovery there is no fee. The written agreement sets out the percentage and how costs are handled before you sign anything.

Should I give the other driver's insurer a recorded statement?

Not before you speak to a lawyer. The adjuster is pleasant, and the call is recorded for a reason. Innocuous phrasing — "I'm fine," said out of politeness two days after a crash — turns up months later as evidence you were not injured.

What is my case worth?

Any lawyer who gives you a number at the first meeting is guessing. Value depends on the severity and permanence of the injury, the total medical expense, lost income and future earning capacity, the available insurance limits, and how clearly liability can be proved. We can give you a realistic range once we have the medical picture.

The crash was partly my fault. Do I still have a claim?

Possibly. Florida uses modified comparative negligence: your recovery is reduced by your share of fault, and is barred entirely if you are found more than 50% at fault. Insurers routinely overstate a claimant's share, which is exactly the sort of thing worth contesting.
